1. Agreement to Terms

By accessing or using the services provided by 404! SOLUTIONS ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

404! SOLUTIONS provides web design, development, and related digital services as described on our website. The specific deliverables, timelines, and costs will be outlined in a separate agreement or statement of work for each project.

3. Payment Terms

Unless otherwise specified in a project agreement, our standard payment terms are 50% of the project cost upfront and the remaining 50% upon completion. All invoices are due within 14 days of issuance. Late payments may incur additional fees.

Prices quoted exclude VAT, hosting costs, domain registration, and third-party service fees unless explicitly stated otherwise.

4. Intellectual Property Rights

Upon full payment, clients will own the rights to the final deliverables created specifically for their project. However, we retain ownership of all preliminary designs, concepts, and code frameworks that are not unique to your project.

We reserve the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in magazine articles, and in books about design.

5. Client Responsibilities

Clients are responsible for:

  • Providing necessary content, materials, and feedback in a timely manner
  • Reviewing and approving deliverables within agreed timeframes
  • Ensuring they have proper rights to all content provided to us
  • Maintaining their website after the project is complete (unless a maintenance agreement is in place)

6. Project Timelines

Project timelines are estimates based on the scope of work. Delays may occur if client feedback is not provided promptly or if the project scope changes. Significant delays caused by the client may result in rescheduling or additional fees.

7. Limitation of Liability

To the maximum extent permitted by law, 404! SOLUTIONS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.

8. Termination

Either party may terminate a project with written notice. If a client terminates a project, they are responsible for paying for all work completed up to the termination date. If we terminate a project, we will provide a prorated refund for any prepaid services not delivered.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the date at the top of these Terms.
